Within the scope of urban transformation, especially in buildings that are considered to pose a risk, if one of the floor owners receives a risky building report, the floor owners may decide to retrofit by providing the 4/5 ratio according to the condominium law. If the 4/5 ratio cannot be achieved in order to make the building earthquake resistant, the building retrofitting consent, which is to the advantage of the owners, can be obtained by court decision by filing a determination case.
The retrofitting report, retrofitting projects and calculations to be prepared for the court decision can be submitted to the court in the legal process. When making a retrofitting decision, the area losses, if any, are taken into consideration in the new zoning status of the building. The ratio of retrofitting cost to reconstruction cost should not exceed 40%.
